1. Scope of application of the general conditions
1.1. These general terms and conditions apply to all reservation requests and contracts concluded - directly or indirectly - with Campingpark Eifel GmbH and refer to all types of accommodation rented by Campingpark Eifel GmbH.
1.2. Campingpark Eifel GmbH expressly rejects the application of other general terms and conditions.
1.3. Exceptions to these general terms and conditions are only possible if the parties agree to this in writing.
2. Reservations
2.1 Campingpark Eifel GmbH will only accept reservations if the person making the booking is older than 18 years. It reserves the right to refuse a reservation request without giving reasons.
2.2 The contract between Campingpark Eifel GmbH and the tenant is concluded at the time when Campingpark Eifel GmbH sends you the reservation confirmation – which also serves as the invoice – by post or email.
2.3 The tenant must check the reservation confirmation for accuracy and immediately report any inaccuracies to Campingpark Eifel GmbH.
2.4 The tenant shall make a partial payment or payment to Campingpark Eifel GmbH within the deadline specified in the reservation confirmation. Campingpark Eifel GmbH is entitled to consider the contract not concluded if the agreed payment or partial payment is not received by Campingpark Eifel GmbH on time. In this case, Campingpark Eifel GmbH has the option of releasing the reserved accommodation for rental to third parties without further notice to the tenant and charging the tenant for the cancellation costs.
3. Changes to reservations
3.1 Campingpark Eifel GmbH is not obligated to make changes to the contract at the request of the tenant after the contract has been concluded. If Campingpark Eifel GmbH makes a change, it reserves the right to charge the tenant a change fee of at least €10 per change.
4. Prices
4.1 The tenant owes Campingpark Eifel GmbH the agreed rental price as stated on the reservation confirmation.
4.2 The prices and additional costs are listed in the price list on the Campingpark Eifel GmbH website.
4.3 Unforeseen price increases imposed by the authorities may be passed on to the tenant. All prices in the price list are subject to change.
4.4 Any discount promotions do not apply to existing/completed bookings.
5. Payment
5.1 The tenant must pay a deposit of twenty percent (20%) of the rental price within fourteen (14) days of booking, as well as the full cost of cancellation insurance, reservation fees, and any special requests. The tenant must pay the remaining 80 percent (80%) of the rental price and any additional fees 30 days prior to the arrival date.
5.2 If a reservation was made 30 days or less before the arrival date, the total amount according to the reservation confirmation must be paid by the tenant to Campingpark Eifel GmbH within eight days of the reservation.
5.3 The tenant has no right to a (partial) refund of the travel contract if the tenant leaves before the agreed departure date.
5.4 Campingpark Eifel GmbH reserves the right to cancel the reservation and to release the accommodation for rental to third parties without further notice if a payment deadline has expired and the tenant has not fulfilled his obligations.
5.5 Campingpark Eifel GmbH has the right to terminate the contract without the need for notice of default or legal intervention if: - the entire rental price is not paid at the start of the rental period - the deposit is not paid at the start of the rental period - the tenant leaves the rental property early - the tenant fails to occupy the rental property before 5 p.m. on the day the rental period begins, without notifying Campingpark Eifel GmbH in good time that the rental property will be occupied at a later date during the rental period.
6. Changeover days
6.1 Arrival and departure are possible on Mondays and Fridays, unless otherwise stated in the brochure. Campingpark Eifel GmbH will state the arrival date on the reservation confirmation.
6.2 The tenant may occupy the rental property from 3 p.m. on the day of arrival and must vacate the rental property before 10 a.m. on the day of departure.
7. Deposit
7.1 The tenant must pay a deposit upon arrival at reception or provide a written authorization for the deposit. Campingpark Eifel GmbH determines how the tenant must pay the deposit.
7.2 The deposit serves as security for Campingpark Eifel GmbH. Any damage caused by the tenant to the rental property or within the holiday park during the rental period will be deducted from the deposit. Additional costs, such as additional cleaning costs due to excessive dirt, may also be deducted from the deposit.
7.3 Campingpark Eifel GmbH will cancel the direct debit authorization if no damage or additional costs are discovered during the final inspection of the apartment. If damage or additional costs are clearly identified during the final inspection, the amount of the damage will be debited from the tenant's account. The charge will never exceed the amount authorized. If the deposit is insufficient to cover the damage and costs, Campingpark Eifel GmbH will subsequently collect the additional costs from the tenant.
7.4 Campingpark Eifel GmbH will refund the tenant a deposit paid in cash after the final inspection of the rental property, less any damages and costs.
8. (House) Rules
8.1 All guests must adhere to the rules established by the park, including those set out in the park regulations. Campingpark Eifel GmbH reserves the right to immediately remove the renter and any accompanying persons from the park (or have them removed) if the house rules are violated or instructions from staff are not followed. In this case, the renter is not entitled to a refund of the rental price (or any corresponding portion).
8.2 Campingpark Eifel GmbH reserves the right to make changes to the concept and opening hours of the park's facilities. The tenant agrees that necessary maintenance work may be carried out on the rental property during the rental period. The tenant may not claim compensation. Campingpark Eifel GmbH will determine the necessity of maintenance work at its sole discretion. The tenant also agrees that maintenance work may be carried out on the park's facilities during their stay.
8.3 The tenant uses the rental property exclusively as a holiday home.
8.4 The rental property will be made available to the tenant upon handover of the keys. The keys will only be handed over if the full rental price and all additional costs have been received by Campingpark Eifel GmbH. The tenant must return the keys to the park reception before 10:00 a.m. on the agreed departure date.
8.5 The landlord undertakes to hand over the rental property to the tenant at the agreed time, clean and in good condition. The rental property, including the inventory contained therein, as listed in the inventory list, shall be deemed accepted by the tenant unless the tenant objects within four hours of moving into the rental property.
8.6 The tenant must grant employees of Campingpark Eifel GmbH direct access to the rental property at all times.
8.7 As a tenant of the rental property, you may not rent or use the property to third parties, nor may you accommodate more people than those stated in the reservation and on the confirmation. Campingpark Eifel GmbH reserves the right to terminate the contract immediately and without legal intervention if it determines that the agreed number of people in the apartment has been exceeded.
8.8 The tenant is obligated to treat the rental property and its contents with care. The tenant must leave the property in a tidy and clean condition upon departure. Any damage caused to the property by the tenant or their co-occupants must be reported to Campingpark Eifel GmbH prior to departure. This will be billed immediately.
8.9 The tenant is obligated to always properly lock the rental property when absent. Campingpark Eifel GmbH will charge the tenant for any damage resulting from a breach of this obligation.
8.10 It is not permitted to use any cooking and washing equipment in the rental property other than those provided by Campingpark Eifel GmbH.
8.11 Any waste generated during your stay must be disposed of in the designated containers by 10:00 a.m. on the day of departure at the latest.
9. Pets
9.1 The price lists indicate whether the tenant is allowed to bring pets and, if so, how many pets are permitted per accommodation.
9.2 The tenant must indicate at the time of booking whether they wish to bring pets. The costs for pets are listed in the price list.
9.3 The renter must follow any instructions issued by the park. Pets must not be a nuisance to other guests. Dogs must always be kept on a leash.
10. Force majeure
Campingpark Eifel GmbH reserves the right to provide the tenant with equivalent alternative accommodation if the rental property is unavailable due to force majeure or other circumstances. In this case, the tenant cannot take legal action against Campingpark Eifel GmbH.
11. Liability
11.1 Campingpark Eifel GmbH accepts no liability for theft (including theft from lockers in the swimming pool), loss or damage of or to property or persons of any kind during or as a result of a stay at our park.
11.2 Campingpark Eifel GmbH assumes no liability if the tenant’s stay at the park does not meet his or her expectations.
11.3 Campingpark Eifel GmbH assumes no liability for damage or injury to property or persons as a result of staying on the premises or through the use of the facilities available on the premises.
11.4 Campingpark Eifel GmbH is not liable for claims for damages caused by noise pollution from third parties.
11.5 Campingpark Eifel GmbH is not liable for damages resulting from information provided verbally or by telephone by its employees.
11.6 Campingpark Eifel GmbH is not liable if facilities or equipment become damaged or unusable.
11.7 The renter and accompanying persons are jointly and severally liable for any loss or damage to the rental property and other property belonging to Campingpark Eifel GmbH (or the private property owners) that occurs during the rental period. This applies regardless of whether the damage is the result of an act or omission of the renter, accompanying persons, or third parties who are in the park on behalf of the renter.
11.8 The tenant is obligated to pay all additional costs resulting from improper use or improper leaving of the rental property. This includes, but is not limited to, excessive contamination. Campingpark Eifel GmbH may offset these additional costs against the deposit.
11.9 The tenant declares that he is aware of the location, furnishings and proper condition of the premises based on the (written) information provided, brochures, etc.
11.10 Almost all apartments are privately owned. The furnishings and layout of the apartments may therefore vary.
11.11 It is possible that (part of) the park may be closed or restricted during certain weeks of the year. To ensure that all facilities are accessible during your stay, we recommend that you inquire about this when making your reservation. This will avoid any potential disappointment upon arrival at the park.
12. Complaints
12.1 Despite all care and effort on the part of Campingpark Eifel GmbH, you may occasionally have cause to complain. Complaints must be reported immediately to the park reception. If the cause of a complaint cannot be remedied immediately or is not resolved to your satisfaction, you must write down the complaint during your stay. You can do this using the complaint form available at reception. This complaint must be signed by a reception member of staff. You must then send the complaint form, signed by the park, with a covering letter if necessary, within eight days of your departure date to: Campingpark Eifel GmbH Schwimmbadstraße 7 54649 Waxweiler This action is absolutely necessary so that the complaint can be handled correctly.
13. Cancellation conditions
13.1 In the event of cancellation of a reservation, Campingpark Eifel GmbH will charge the tenant a fixed compensation per accommodation in the amount of:
- 30% of the agreed rental price for cancellation up to 42 days before the arrival date.
- 60% of the agreed rental price for cancellation from the 42nd day to the 28th day before the arrival date.
- 90% of the agreed rental price for cancellation from the 28th day up to the day of arrival.
- 100% of the agreed rental price if cancelled on the day of arrival or later.
